New Force Spokesperson Shalimar Abbuisi Wins Human Rights Case Against Ghana As ECOWAS Court Awards $10,000 In Damages

In a historic ruling, the ECOWAS Court of Justice has declared the Republic of Ghana guilty of violating the human rights of Shalimar Abbuisi, a spokesperson for the New Force political movement.

The court found that Abbuisi’s wrongful arrest, rearrest, and deportation in December 2023 constituted a breach of her fundamental rights.

The judgment, delivered on November 22, 2024, concluded that the actions of the Ghana Immigration Service violated Article 6 of the African Charter on Human and Peoples’ Rights, which guarantees individual liberty and security.

Consequently, the court directed the government of Ghana to compensate Abbuisi with $10,000 (approximately GHC160,000) for the harm caused.

Abbuisi, a Belgian national, was initially arrested over allegations of fraudulently obtaining a student permit. However, after the State Prosecutor dropped the charges, she was rearrested and deported to Belgium under an Executive Instrument.

The court highlighted the unlawful nature of these actions, emphasizing the significant damage caused to her personal and professional reputation.

Following the ruling, Abbuisi expressed her joy and vindication, stating, “I WON MY COURT CASE AGAINST THE STATE OF GHANA!!! ECOWAS Court rules that the rearrest and detention on 19th December 2023 and eventual deportation of Shalimar Abbuisi was an unlawful violation to liberty. I am vindicated—I thank GOD. This is a beautiful day for humanity; we are writing history.”

Her legal team, led by renowned human rights lawyer Francis-Xavier Sosu and Lawyer Belinda Narkey Quaynor, lauded the court’s decision. Sosu commented, “We feel vindicated that the ECOWAS Court has upheld the rights of Shalimar.”

The New Force political movement also celebrated the verdict, describing it as a victory for justice and a reinforcement of democratic principles.

This landmark case underscores the critical role of regional courts in safeguarding human rights and holding governments accountable for violations. It serves as a potent reminder of the importance of respecting individual freedoms and upholding the rule of law.
