The National Democratic Congress (NDC) has filed a lawsuit against the Electoral Commission (EC) over the re-collation of parliamentary election results in five constituencies.
The NDC is seeking a judicial review to prevent the EC from re-collating and re-declaring the results in the Dome Kwabenya, Okaikwei Central, Ablekuma North, Tema Central, and Obuasi East constituencies.
According to the NDC, the EC’s decision to re-collate the results is unconstitutional, as the commission had already declared the winners in those constituencies.
The party argues that the EC has “become functus officio” and therefore lacks the authority to re-collate, recount, and re-declare the results.

The NDC is seeking an order of prohibition to prevent the EC from re-collating the results, as well as a declaration that the commission’s decision to re-collate the results is unconstitutional. The party is also seeking an injunction to restrain the EC from re-collating the results.
This development comes amidst a dispute over the parliamentary election results in some constituencies, with the EC asking for re-collations to be put on hold. The NDC’s lawsuit is the latest twist in the ongoing controversy over the election results.
